ADELAIDE and Kurt Tippett will have to treat their preparation to answer AFL charges as though they were facing criminal charges, a leading Adelaide solicitor says.
And a possible need for legal teams boosted by high-ranking Queen's counsels to challenge AFL draft and salary cap rules means the legal bill for each of Crows chief executive Steven Trigg, former football manager John Reid and Tippett could balloon to six-figure sums.
Kelly & Co's Peter Campbell said depending on their defence tactics, it was likely the Adelaide Football Club, Trigg and Reid would need separate legal teams to defend them.
If any party chose to challenge AFL laws, then a possible team including a QC supported by a junior barrister and solicitors could push the cost past $100,000 - a bill that might leave Trigg and Reid out of pocket.
"Given the potential penalties, it would come as no surprise that there would be QCs all over it," Campbell said.
"Particularly if they want to try and pick holes in the process, or challenge the way the AFL has gone about its investigations.
"Because Trigg and Reid are facing charges for conduct which is outside what the club could legitimately authorise, they may not be indemnified and would have to pay their own legal bills."
Campbell said the hearing starting on Monday at AFL House in Melbourne, involving draft tampering and salary cap breaches, hinged on the AFL proving the charges.
"It's a breach of the AFL rules, not a criminal matter, but in terms of their position in the AFL competition they've agreed to abide by those rules," Campbell said.
"The defence will look at all the elements of the charges - `what does the AFL have to do to obtain a "guilty" verdict?'
"If the Crows or any of the individuals say `we don't think the AFL can prove that against us,' then we may see challenges to evidence or the charges themselves, or even the validity of the AFL Rules."
